My father recently passed away without a will. I understand that my family have to go to probate court. He own a house outright and a piece of land that he still pay mortgage on. To my understand that all of us in the family will get some of his properties. I currently live out of the US and don’t plan to come back any time soon ( i did came back for his funeral). Wil the probabe court contact me about his properties? I don’t want any of it and I want to give it all to my mother, can I write a letter or is there a form for me to fill out that DECLINE any involment and that my mother can represent me in court? any advice is greatly needed…

The executor of the estate will contact you (probably your mother).
You can disclaim any right to inherit, in favor of your mother (there will be a form to sign, probably notarized).
Don’t concede your share yet. Take it, then give it to your mother.

But was you mother still married to dad when he died? If so, it’s all going to your mother anyway, so no elaborate probate is necessary.
Huh? Unless you are a minor you have to claim to any share of the estate if dad was married to mom when he died. What makes you think you do? Unless there is a reason to contact you then you will not be contacted the states have mandated ways of handling these issue with a wedow/er and MINOR Children.
